What’s the difference between a DWI and a DWAI?

What’s the difference between a DWI and a DWAI?

New York does not use the term “DUI.” It is strictly DWI (driving while intoxicated) and DWAI (driving while ability impaired, under the influence of either alcohol or drugs). Here are a few things to note about the distinctions between these charges:

  • DWI means the driver is technically drunk. Their BAC (blood alcohol content level) is over 0.08. This is a criminal charge.
  • DWAI-Alcohol means the driver has a BAC of 0.05 to 0.07. They are impaired, but not legally intoxicated. This is a violation under New York law.
  • DWAI-Drugs is the operation of the motor vehicle while impaired by drugs, either legal or illegal. DWAI-Drugs is a misdemeanor unless it is the defendant's second charge within 10 years, in which case it is a felony.

Attorney Colosi has extensive experience dealing with college students who get DWIs or DWAIs. We maintain the student's confidentiality during this time. Attorney Colosi also has experience dealing with interlocks and conditional discharges. Call Christopher B. Colosi Attorney at Law when you need a DWAI and DWI attorney in Ithaca, New York.
