New York does not use the term “DUI.” It is strictly DWI (driving while intoxicated) and DWAI (driving while ability impaired, under the influence of either alcohol or drugs). Here are a few things to note about the distinctions between these charges:

  • DWI means the driver is technically drunk. Their BAC (blood alcohol content level) is over 0.08. This is a criminal charge.
  • DWAI-Alcohol means the driver has a BAC of 0.05 to 0.07. They are impaired, but not legally intoxicated. This is a violation under New York law.
  • DWAI-Drugs is the operation of the motor vehicle while impaired by drugs, either legal or illegal. DWAI-Drugs is a misdemeanor unless it is the defendant's second charge within 10 years, in which case it is a felony.
